Pushing Rope is reporting that Mark Foley will not be prosecuted because the three-year statute of limitations have expired. The law Foley would have been prosecuted under is Florida Statute 847.0135. (The Blotter)
Let me say this about that. The "CERTAIN USES OF COMPUTER SERVICES PROHIBITED" statute is just one Florida law applicable to Foley. We've got sex offense laws growing on trees like oranges down here...the FDLE can just take their pick.
With that sort of legal observation, the Frog is certain a grapefruit or a mango of a statute lies considered among the legal trees--ready for harvest-- just for Mr. Foley.
It's not over for Foley until the Sunshine State says it's over.
America's Wang--as my friend Blast Off! so affectionately calls our home state--has a lot of explaining to do if Mark Foley is not charged. Hundreds of Floridians have been ruined due to laws in this state that have felonized inappropriate behavior--and yet, the Top Cops will let the Big Fish walk?
I want to say doubtful. But then, guys like Foley and Craig and Bob Allen obviously consider themselves "unarrestable" and above the law. (Why are Republicans more scandalous than Democrats?)
If Foley does walk, let's not forget--as co-chair of the Congressional Missing and Exploited Children's Caucus--his fingers played a part in the passage of federal law which practically exiles those convicted of sexual offenses--many which involve no physical contact with anyone at anytime.
(Not to mention--but I will--that Orrin Hatch secured his Utah cartel THE contract for TrackerPAL ankle bracelets via the AWA).
For such a legislative sham, I demand Congress repeal the Adam Walsh Act and any other piece of sexual offense legislation Mr. Do As I Say and Not As I Do played a part in developing.
Oh, and by the way. Big thank you to the St. Pete Times for sitting on this story for one year. That helps out with the statute of limitations thing.
The Raw Story is also reporting that ABC held "elements of the story" as well for almost the same time period. Double thanks.
With a press like that, no wonder this country has gone fascist.
