America's judges appear to have finally figured out that the United States has simply degenerated to a legislated police state.First, Judge Sauer cuffs and stuffs the rich and famous Paris Hilton straight back to jail and today, Judge Thomas H. Wilson threw out the sentence of Genarlow Wilson, convicted under Georgia's Draconian sex offender laws.
Bravo, your Honors!
Although prosecutors indicate the order will be appealed, the Frog suggests the state of Georgia seek legal counsel as my hopes are that legal representation will certainly advise Mr. Wilson-now 21 years of age- to sue the hell out of the Peach State for his two years spent behind bars.
The tide is turning against this nonsense...and it's about damn time.
Read on for further details.
As reported by The New York Times.....
In granting Mr. Wilson’s habeas corpus petition, Judge Wilson wrote that it would be a “grave miscarriage of justice” for Mr. Wilson to be kept in prison for the remaining eight years of his sentence.
“If this Court, or any court, cannot recognize the injustice of what has occurred here, then our court system has lost sight of the goal our judicial system has always strived to accomplish: Justice being served in a fair and equal manner.”
Critics pointed out that if Mr. Wilson had engaged in full sexual intercourse with the girl instead of oral sex, under Georgia law he could have been charged only with a misdemeanor, because of an exemption written into the molestation law specifically to cover contact between minors. But because that exemption did not mention oral sex, when Mr. Wilson was convicted, he received a mandatory sentence of ten years in prison without possibility of parole.
